This GDPR Compliance Statement sits in line with our Privacy Policy, is supplemental and applies to all European Union and UK Citizens that are using our website and online services (our “Services”). Accordingly, Belledune Port Authority proceeds with all data processing procedures (e.g., collection, processing, and transmission) as set out in Regulation (EU) 2016/679 (General Data Protection Regulation) and the UK’s Data Protection Act 2018 and both collectively the “GDPR”.

Updating your information and withdrawing your consent
If you believe that the information we hold about you is inaccurate or request its rectification, deletion, or object to its processing, please do so by contacting us.
Access Request
In the event you want to make a Data Subject Access Request, please contact us. We will respond to requests regarding access and correction as soon as reasonably possible. Should we not be able to respond to your request within thirty (30) days, we will tell you why and when we will be able to respond to your request. If we are unable to provide you with any Personal Data or to make a correction requested by you, we will tell you why.

LEGAL BASES FOR PROCESSING
The processing of your Personal Data may be based on the following legal grounds:

Art. 6 (1) lit. a) GDPR serves as our legal basis for processing operations where we obtain your consent for a specific processing purpose.

Art. 6 (1) lit. b) GDPR, insofar as the processing of Personal Data is necessary for the performance of a contract. The same applies to such processing operations that are necessary for the performance of pre-contractual measures, for example in the case of enquiries about our products or services.

Art. 6 (1) lit. c) GDPR, insofar as we are subject to a legal obligation that requires the processing of Personal Data, such as for the fulfillment of tax obligations.

Art. 6 (1) lit. f) GDPR applies on the basis of our legitimate interests, e.g., when using service providers for example for statistical surveys and analyses and logging registration procedures. Our interest is directed towards the use of a user-friendly, appealing, and secure presentation as well as optimization of our services, which serves our business interests as well as meeting your expectations.
DURATION OF STORAGE AND ROUTINE DELETION OF PERSONAL DATA
We process and store your Personal Data only for the period of time required to fulfill the purpose of storage or if this has been provided for, in laws or regulations for up to 7 years. After the purpose has ceased to exist or has been fulfilled, your Personal Data will be deleted or blocked.
In the case of blocking, deletion will take place as soon as legal, statutory, or contractual retention periods do not conflict with this, there is no reason to assume that deletion would impair your interests worthy of protection and deletion would not cause a disproportionately high expense due to the special nature of the storage.
AUTOMATICALLY COLLECTED DATA
a) Provision and use of the website
When you visit and use our website, we collect the Personal Data that your browser automatically transmits to our server. This is technically necessary for us to display our website and to ensure its stability and security. In this sense, we collect the following data: i) IP address of the requesting computer, ii) Date and time of access, iii)name and URL of the file accessed, iv) website from which the access was made (referrer URL), v) browser used and, if applicable, the operating system of your computer as well as the name of your access provider. The legal basis is our legitimate interest.
b) Hosting
The hosting services used by us for the purpose of operating our website is Wix.com LTD (Shlomo Ibn Gabirol St 71, Tel Aviv-Yafo, 6416202, Israel). In doing so Wix processes inventory data, contact data, content data, usage data, meta data and communication data of customers, interested parties and visitors of our website and services, on the basis of our legitimate interest Article 6 (1) lit. f) GDPR.
c) Content Management System
We also use the Content Management System (CMS) of Wix to publish and maintain the created and edited content and texts on our website. This means that all content and texts submitted to us is transferred to Wix. This represents a legitimate interest Article 6 (1) lit. f) GDPR.
d) Cookies
We use cookies on our website. In accordance with Canada’s Anti-Spam Law (“CASL”), the UK`s Privacy and Electronic Communications Regulation (“PECR”) and the EU`s Privacy and Electronic Communications Directive (“PECD”) we are required to obtain your consent before placing so-called Non-Essential Cookies (Functional cookies, Analysis and Performance Cookies, Advertising Cookies or Targeting Cookies). e) Cookie consent
Our website uses a cookie consent tool "Cookiebot" from Usercentrics (Usercentrics A/S, Havnegade 39, 1058 Copenhagen, Denmark) to obtain your consent to the storage of cookies and to document this consent. f) Economic analyses and market research
For business reasons, we analyze the data we have on web and server traffic patterns, website interactions, browsing behavior etc. The analyses serve us alone and are not disclosed externally and processed using anonymous analyses with summarized and or anonymized values. For this purpose we use Google Analytics by Google LLC (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA and Gordon House, Barrow Street, Dublin 4, Ireland), LinkedIn Insights by LinkedIn (605 W Maude Ave, Sunnyvale, CA 94085, USA). g) Fonts
We use Google Fonts by Google LLC and Font Awesome of Fonticons Inc (307 S Main St Ste 202 Bentonville, AR, 72712-9214 USA) on our website to display external fonts. To enable the display of certain fonts on our website, a connection to a Google/Font Awesome server is established when our website is accessed. The connection to Google/Font Awesome established when you call up our website enables Google/Font Awesome to determine which website sent your request and to which IP address the display of the font is to be transmitted. This represents a legitimate interest Article 6 (1) lit. f) GDPR.
h) YouTube Videos
We have integrated videos from YouTube (Google LLC). The integration requires that YouTube can perceive the IP address of the user. The IP address is required in order to send the video content to the user's browser. If you click on a YouTube video on our website, your internet browser will be prompted to download a corresponding representation of the video and also places certain cookies. In this way, YouTube knows which specific sub-pages you have visited. The legal basis is our legitimate interest Article 6 (1) lit. f) GDPR and your consent Article 6 (1) lit. a) GDPR. DIRECTLY COLLECTED DATA
a) Contact
The processing of Personal Data depends on the nature of your contact. In addition to your name and email address, IP address or phone number, we usually collect the context of your message, which may also contain certain Personal Data. The Personal Data collected when you contact us is used to process your request, and the legal basis is your consent Art. 6 (1) lit. a) GDPR.
b) Contractual Relationship
In order to establish or implement the contractual relationship with our users, it is regularly necessary to process the personal master data and contract data provided to us. The legal basis for this processing is Art. 6 (1) lit. b) GDPR.
We also process customer and prospect data for evaluation and marketing purposes. This processing is carried out on the legal basis of Article 6 (1) lit. f) GDPR and serves our interest in further developing our offer and informing you specifically about our offers.
Further data processing may take place if you have consented (Article 6 (1) lit. f) GDPR) or if this serves the fulfillment of a legal obligation (Art. 6 (1) lit. c) GDPR).
c) Commercial and Business Services
We process information of our contractual and business partners, e.g., users and interested parties in the context of contractual and comparable legal relationships as well as related measures and in the context of communication with contractual partners (or pre-contractual), e.g., to answer enquiries.
We process this information to fulfill our contractual obligations, to secure our rights and for the purposes of the administrative tasks associated with this information as well as for business organization. We only disclose the information of our contractual partners to third parties within the scope of the applicable law to the extent that this is necessary for the aforementioned purposes or for the fulfillment of legal obligations or with the consent of the contractual partners (e.g., auxiliary services as well as subcontractors, banks, tax and legal advisers or tax authorities).
Unless otherwise specified the purposes of processing are Contractual performance and service, contact requests and communication, office and organizational procedures, administration, and response to requests, visit action evaluation, interest-based and behavioral marketing. And the Legal bases are Art. 6 (1) lit. b) GDPR, Art. 6 (1) lit. c) GDPR, and Art. 6 (1) lit. f) GDPR.
d) Administration, Financial Accounting, Office Organization,
We process data in the context of administrative tasks as well as organization of our operations, financial accounting and compliance with legal obligations, such as archiving. In this regard, we process the same data that we process in the course of providing our contractual services. The processing bases are Article 6 (1) lit. c) GDPR, Article 6 (1) lit. f) GDPR. Users, interested parties, business partners and website visitors are affected by the processing. The purpose and our interest in the processing lies in the administration, financial accounting, office organization, archiving of data, i.e., tasks that serve the maintenance of our business activities, performance of our tasks and provision of our services. The deletion of data with regard to contractual services and contractual communication corresponds to the data mentioned in these processing activities. In this context, we disclose or transfer data to the tax authorities, consultants, such as tax advisors or auditors, as well as other fee offices.
e) Information processing for the purpose of fraud prevention and optimization
Where applicable, we provide our service providers with further information, which they use together with the information necessary for fraud prevention and optimization of our processes This serves to protect our legitimate interests Article 6 (1) lit. f) GDPR in our protection against fraud or in efficient risk management, which outweigh our interests in the context of a balancing of interests.
f) Technical services
We process the data of our users and clients in order to enable them to select, purchase or commission the selected services as well as associated activities or to execute or provide them. The required information is identified as such in the context of the service provision, or comparable contract conclusion.
Unless otherwise specified the purposes of processing are Contractual performance and service, contact requests and communication, office and organizational procedures, administration, and response to requests, visit action evaluation, interest-based and behavioral marketing. And, the Legal bases are Contractual performance and pre-contractual inquiries, Legal obligation, and our Legitimate interests. Art. 6 (1) lit. b) GDPR, Art. 6 (1) lit. c) GDPR, and Art. 6 (1) lit. f) GDPR.
ADVERTISING
We would like to show you interesting advertising outside of our website and use various third-party tools and cookies for this purpose. These collect and process information about your activities on our website - for example, which products you are interested in or which pages you visit. By knowing what you are looking for and how you use our website, we can adapt our advertising to your needs. And thus increase the likelihood that you will also be shown suitable and interesting advertising outside our website.

a) General
We are present on social media on the basis of our legitimate interest (Facebook, Instagram, (Meta Platforms, Inc., 1601 Willow Road Menlo Park California 94025 and 4 Grand Canal Square Grand Canal Harbour Dublin 2 Ireland) X (formerly Twitter) (Market Square, 1355 Market St suite 900, San Francisco, CA 94103, United States), LinkedIn and YouTube (Google)). If you contact or connect with us via social media, we and the relevant social media platform are jointly responsible for the processing of your data and enter into a so-called joint controller agreement. The Personal Information collected when contacting us is to handle your request and the bases are both your consent and our legitimate interest.
b) Market research and advertising
In addition, your data may be processed for market research and advertising purposes. For example, usage profiles can be created from your usage behaviour and the resulting interests. This allows, for example, advertisements to be placed within and outside the platforms that presumably correspond to your interests. The legal basis is our legitimate interest. c) When you visit our profiles and interact with us and others
When you visit our social media profiles, we, as the operator of the profile, process your actions and interactions with our profile (e.g., the content of your messages, enquiries, posts or comments that you send to us or leave on our profile or when you like or share our posts) as well as your publicly viewable profile data (e.g., your name and profile picture). Which Personal Information from your profile is publicly viewable depends on your profile settings, which you can adjust yourself in the settings of your social media account. The legal basis is our legitimate interest and your consent.
DISCLOSURE OF PERSONAL DATA TO THIRD PARTIES
Your Personal Data will only be passed on if there is a legal obligation to do so or to service providers and partner companies that have been carefully selected in advance and are contractually obliged to comply with the requirements of data protection law.
a) Disclosure to service providers according to Art. 6 (1) lit. b) and f) GDPR
For the operation and optimization of our website and our services and for the processing of contracts, various service companies work for us, e.g., for IT services or the hosting of our website, for providing of our mobile application or for the dispatch of newsletters, to whom we pass on the data required for the fulfillment of the task.
These companies act for us by way of commissioned processing and may therefore use the data provided exclusively in accordance with our instructions. In this case, we are legally responsible for appropriate data protection precautions at the companies we commission. We therefore agree on specific data security measures with these companies and monitor them regularly.

We will disclose your data to third parties or government agencies within the framework of existing data protection laws if we are legally obliged to do so, e.g., due to official or court orders, or if we are entitled to do so, e.g., because this is necessary for the prosecution of criminal offenses or for the exercise and enforcement of our rights and claims.
DATA TRANSFER TO THIRD COUNTRIES
We usually do not transfer Personal Data outside Canada, however, if we do we take additional measures to ensure an adequate level of data protection for the transfer of Personal Data in accordance with Art. 44 of the GDPR and thus ensure that the transfer is generally permissible and that the special requirements for a transfer to a third country are met (e.g., by concluding EU standard contracts and additional guarantees, supplementary technical and organizational measures such as encryption or anonymization).
GENERAL TECHNICAL ORGANIZATIONAL MEASURES
We have taken a variety of security measures to protect Personal Data to an appropriate extent and adequately. All information held by us is protected by physical, technical, and procedural measures that limit access to the information to specifically authorized persons in accordance with our Privacy Policy and this Statement.
Our website is using Hypertext transfer protocol secure (HTTPS), which is the primary protocol used to send data between a web browser and a website. HTTPS is encrypted in order to increase security of data transfer.
